No one deserves to be physically or sexually assaulted. However, when someone is accused of doing so, they deserve the right to be presumed innocent until and unless proved guilty in a Tennessee court of law. Anyone facing allegations of sexual assault and/or battery should enlist the assistance of a criminal defense attorney as soon as possible to ensure that his or her rights are protected.
For instance, police have taken a 25-year-old Tennessee man into custody on allegations of sexual assault. A woman was out for a run in one of Tennessee's state parks when she claims a man came out of nowhere and attacked her. Reports indicate that she was punched in the face, grabbed and choked. She struggled with her attacker and even attempted to take a photograph of him with her cellphone, but her attacker grabbed the phone out of her hand.
Reports did not indicate what led police to the man that was arrested in connection with the incident. He is currently charged with sexual battery, aggravated assault, and robbery, along with felony evading. His bond was set at $100,000 when he made his first court appearance on Nov. 4.
As would be the case for any other Tennessee resident facing allegations of sexual assault or battery, this man's criminal defense team will more than likely be reviewing the evidence prosecutors intend to present to the court, along with any witness statements. Furthermore, it will be incumbent on prosecutors to prove that he is the man who actually assaulted the victim. Once his team has a clear understanding of the facts and evidence, they will discuss what option will give him the best outcome to the charges.
